03 October, 2019:Raise your strong voice against the retrenchment order of contract workers --- Order issued on 30th September, 2019, by BSNL Management.

At last, Corporate Office has issued the instruction on 30th September, 2019, addressed to all Circle Heads wherein it is stated that 5 nos. of conditions has been marked  to engage the contractual workers. If it is accepted by the Circle heads, then only one month wages will be released for the contract workers. However, it is learnt that a meager amount has been released by Corporate Office for one month payment to the contractual workers. Though, Corporate Office issued the negative instruction and certainly BSNLCCWF will react on the issue strongly and effectively but presently we should take all out effort to disburse the amount to the contract workers before Puja/Dashera festival. All Circle /District Secretaries are requested to take proper initiative with local administration so that one month payment can be made to the contractual workers. BSNLCCWF will finalise the course of action against the black act issued on 30th September,2019, by the BSNL Management.<>

 

03 August, 2019:VDA rate for the Contract Labourers has revised by the CLC New Delhi though the Corporate Office not yet endorsed to the circle heads.

It is reported that the Ministry of Labour has already revised the rate of variable Dearness Allowance for the Contract Labours. The Chief Labour Commissioner has issued the order on 27th March, 2019, for the Industrial Workers which covers Telecom / Telephone Department also. But the Corporate Office not yet endorsed the order though it should come into force w.e.f. 01.04.2019 as it had notified by the CLC, New Delhi.<> <>

 

23 July, 2019:Rules and Conditions for the Casual Labourers for contribution in the gratuity trust of BSNL - Management issued the clarification.

It is well known to everybody that the BSNL Board had taken the decision to extend the benefit of Gratuity to the Casual Labourers after a continuous struggle of BSNLEU and BSNLCCWF in this regard.  Accordingly, the order was issued on 14.11.2018 and presently, the Casual Labourers are getting the benefit also. Now, the Corporate Office has asked some questions to the field units about the actual process of calculating the gratuity amount as well as the assessment of the completed years of service or yet to be completed. Corporate Office has requested the CGMs/GMs to furnish a report within 25.07.2019 with a specific form as it has notified by the Corporate Office vide letter File No-11-3/2014-LB/(ii) dated 17.07.2019. Please note that the continuous struggles of the BSLNEU and BSNLCCWF has created the situation to include the Casual Labours in the same Gratuity Trust of BSNL.<>  

 

23 July, 2019:Management wants to know the total strength of Contract Labourers in BSNL. But for what purpose?

The BSNL Management is now very much serious to collect the data and figure of the Contract Labourers working in BSNL. They had issued one circular in the month of June 2019 addressed to all circle heads about the status of Contract labourers working in the field units engaged directly through Labour / Job contract or Out Source System. Now, they have issued another letter on 19th July, 2019 addressed to all CGMs to collect the information about the Contract Workers, especially the Contract Workers engaged through tenders in term of “Man Power/ Labour Units/ Job Contract or the Workers engaged through” Job/ work execution” Contracts. Even, they want to get the report again and afresh in tern of “Number of different workmen engaged per tender” It is the BSNLEU and BSNL Casual Contract Workers Federation who have created the pressure through a sustained struggle throughout the country to take proper action for the betterment of Contract Labours. That’s why the Management is now so serious about the Contract Workers. Our circle and district secretaries are requested to discuss the matter with the BSNLEU leadership to take proper action so that the actual report may come from the field Units.<>

 

23 May, 2019:Corporate Office letter on validation of data of casual labourers / TSMs in ERP for payment of wages.<>

 

26 April, 2019:Wage payment of casual labours in ERP system - Corporate Office accepted the demand of BSNLCCWF.

It is a good news that the Corporate Office has taken a decision to make the payment of wages to the casual labours including TSMs in ERP system. Since the introduction of ERP system, the BSNLCCWF are demanding that the wage payment of casual labours should be through ERP System. Though it is late, but now the Corporate Office has taken the decision to create a new template for the casual labours and TSMs so that the wage payment can be materialised to the casual labours w.e.f. 1st April 2019. Corporate Office has issued an order to all CGMs to collect all the documents from the individuals so that it can be uploaded in ERP system. It is about 3,500 casual labours who could not be regularised in due time due to the management lapses but still in service since DOT period. It is the BSNLEU and BSNLCCWF who are continuously pursuing the demands of casual labours with the BSNL Management at appropriate level. Circle Secretaries are requested to discuss the matter with the local administration so that the Corporate Office can release the wage payment for the casual labours in ERP system.<>.

24 May, 2018:Corporate Office has revised the wages of casual and contract workers based on new VDA and DA order.

VDA order was issued by the Ministry of Labour w.e.f. 01.04.2018 and the Central Government has also revised the wages of casual labours after calculation of new DA rate. CHQ had taken up the issue with the GM(Estt.) and GM(Restg.), BSNL CO., for the endorsement of both the orders from Corporate Office. Recently, the Corporate Office has issued the revised wage rate for the casual and contract workers after recalculation of new DA and VDA order. Circle secretaries are requested to take proper action in this regard.<>

 

 

08 May, 2018:Corporate Office letter on payment of Dearness Allowance (DA) to Casual Labourers [including TSMs] to draw their wages in terms of letter No. 269-11/2009-Pers-IV/LE dated 01.01.2010.<>

 

05 May, 2018:Corporate Office has asked again the circles to send the data of the casual labourers for settlement the gratuity issue. Order enclosed.<>

 

16 April, 2018:Endorsement of DA order for the year 2017 only. Silent for the year 2018. BSNLCCWF has already reacted on the issue.


The order of DA (2 nos.) for Casual Labourers for the year 2017 has been endorsed by the Corporate Office. It is unfortunate that when Govt of India has enhanced the rate of DA for the year 2018 which is now 142% from January, 2018 where as corporate office has endorsed the order of DA for the year 2017. It is a total deprivation and injustice towards the poor paid workers. A great conspiracy by the corporate office. However the issue will be taken up with CMD, BSNL to convey our resentment.<>

 

 

05 April, 2018:VDA for the contract workers wage has already revised by the ministry of the labour.

Recently, the ministry of labour has revised the wages of the contract workers after announcement of VDA. Now, you are requested to pursue the matter with the local administration so that the workers can get right wages. We will pursue the matter for its endorsement from corporate office.<>

21 March, 2017:CLC has issued the order for implementation of the revision of wages for the contract workers. BSNLCCWF is very much serious on the issue.


Based on the gazette notification, the Chief labour Commission has issued order for revision of wages for the contract labours. According to this order the revised wages will be paid from 19th January and the revised VDA will be from 1st April, 2017. We have told CMD BSNL, on 18th March to implement it at the earliest. Circle Secretaries and CHQ office bearers are requested to take up the issues at CGM level.

 

Please recall that the BSNLCCWF leaders had met CLC on 17th January and demanded the revision of wages for the contract workers, now the order is issued. Please mobilise your members to make a good campaign on the issues.<>

08 October, 2016:Bonus Orders issued by BSNL.


The sustained efforts and timely intervention of BSNLEU leaders have resulted in issue of orders granting bonus to the employees before Puja/Dussehra/Navaratri, Muharram. On 06.10.2016(yesterday), Com. V.A.N.Namboodiri, Patron and Com. Swapan Chakraborty, Dy. General Secretary met CMD BSNL, Director(HRD) and also Additional Secretary, DOT and demanded that the Bonus should be ordered this week itself so that the employees will get the same before the festivals.

It has the desired results. Necessary meetings like Remuneration Committee was held urgently and the orders for payment of Bonus of Rs.3,000/- as agreed between the Management and the Recognised Unions have been issued. The casual labour also will get the Bonus as demanded by BSNLCCWF leaders, when they met the CMD BSNL a few days back. Congratulations to all comrades for achieving the desired results!<>

08 October, 2016:Corporate Office letter on implementation of provision of EPF/ESI for contract workers.

BSNL CCWF leaders have been continuously meeting BSNL Management for clear orders on implementation of labour laws like minimum wage, EPF, ESI etc. Com. V.A.N. Namboodiri, President, met Shri A.M. Gupta, GM(Restg.), a few days back and insisted upon issue of clear instructions and monitoring of implementation of government and BSNL orders with regard to contract workers. An order issued by BSNL CO., in this connection.<>

06 January, 2016:Ultimately management in UP (East) circle issued the order for implementing the labour laws.


It was a complain from BSNLCCWF that labour laws is being violated in UP(East). Chq leadership met circle administration after a huge gathering organised by circle union of BSNLCCWF and BSNLEU. As a result on   management issued the order for implement the labour strictly.<> <>

10 December, 2015:Deployment of contract/casual / sanitation workers for per Ministry of Labour and employment Govt. of India perennial nature of jobs in BSNL.


It is learnt that the BSNL authority has issued a letter to all CGM regarding the deployment of contract & casual labours who have engaged in the perennial jobs in BSNL. In response of EPF Dept letter dated on 13.11.2015 the corporate office has issued the letter on 20.11.2015. It is relevant that BSNLCCWF has already highlighted the same issue in the last meeting of standing committee of labour in Mumbai. The Director of Loksabha Secretariat seeking the information of deployment of contract & casual workers for perennial nature of job in BSNL. Accordingly corporate office is collecting the data and figure once again.<>

 

 

09 December, 2015:BSNLCCWF’s continuous perusal of casual and contract labour issues with BSNL Management and Parliamentary Standing Committee on Labour are bearing fruits. BSNL Management has once again reiterated it’s instructions to CGM’s to implement all labour rules. <>

Orders have been  issued by the BSNL C.O. vide F.No.14-04/2015-WS&I dated 20-10-2015 endorsing the order of the Chief Labour Commissioner (Central), New Delhi, increasing the Variable Dearness Allowance for the contract workers with effect from 01-10-2015. Com.VAN Namboodiri, President, BSNLCCWF had met Director (HR) Smt. Sujata Ray on 19th October 2015 and requested for the endorsement to be sent so that the new VDA will be implemented. We greatly appreciate the immediate action on the part of the Director (HR). The order of the CLC has been posted in bsnleuccwf.com as soon as it was issued by the CLC.<>

21 October, 2015:Casual Labour and Contract Labour eligible for Bonus.


The casual labour in BSNL are eligible for Bonus this year as per Govt. of India orders No. 7/24/2007/E III dated 16-10-2015 issued by the Ministry of Finance Department of Expenditure. <>

 

 

16 October, 2015:BSNL issues strict instructions on payment of Minimum Wages and implementation of Social Security Measures like EPF, ESI etc.

In the Parliamentary Standing Committee of Labour meeting held at Mumbai on 12.10.2015, the BSNLCCWF leaders Coms. V.A.N. Namboodiri, President and Animesh Mitra, Secretary General had brought to the notice of the Standing Committee various cases of non-implementation of labour laws, including Minimum Wage Act 1948, EPF Act, Contract Labour Act etc. CMD BSNL, Director (HR) and other top officers who attended the Standing Committee were asked to submit report on these complaints.

 

Now BSNL has issued ‘Top Priority’ letters asking all CGMs to immediately submit reports. Copies of the same are given below.

 

All Circle Secretaries are requested to immediately intimate to CHQ whether Minimum Wages are paid, if not, how much is paid, whether EPF, ESI are implemented etc. to report to Standing Committee. > >

19 August, 2015:Gratuity for Casual labour approved by BSNL Managing Committee.


After much efforts by the BSNLCCWF for implementation of gratuity to the BSNL Casual labours and also taking up the matter in the Parliamentary Standing Committee and several rounds of discussion with the BSNL Management, the BSNL Managing Committee has approved the same. This has to go to the BSNL Board for approval, before necessary orders are issued.

 

This is a great achievement for the casual labours. Congratulations to BSNLCCWF!.<>

19 May, 2015:Great Victory! BSNL C.O. issued orders for EPF Payment to Casual labours from 01-10-2000.


It is a great victory for the BSNLCCWF and the casual and contract workers! The Federation as well as BSNLEU has been demanding that for the casual and contract workers EPF should be implemented from at least 01-10-2000. After much efforts, the BSNL Management had implemented EPF for casual workers from 10-01-2011. In many places EPF was not implemented to the contract workers.

 

These along many other issues were taken by the BSNL Casual & Contract Workers Federation with the Parliamentary Standing Committee on Labour and also the Central Provident Fund Commissioner, New Delhi. The representatives gave detailed evidence before Parliamentary Standing Committee with full documents. The EPF Commissioner held meeting with the President BSNLCCWF and Officers of BSNL on this. Accordingly the EPF Commissioner (Central) issued a strong letter dated 22-04-2015 to BSNL asking them to implement EPF to casual labours w.e.f.01.10.2000 (the date of formation of BSNL) retrospectively. It was also directed that wherever, EPF is not implemented for contract workers, it should be implemented as per EPF Act.

 

Now today, 18-05-2015, the BSNL C.O. has issued the orders directing the CGMs to immediately take action for implementing EPF for casual labours w.e.f. 01-10-2000 and also implement EPF for contract workers, wherever it is not implemented so far. Not only the EPF contributions will be made by BSNL management, but interest also will have to be paid, which will benefit the workers. The EPF with retrospective effect from 2000 will benefit the existing 3469 casual labours.

 

The mammoth CMD Office March on 15th October 2014 and the Two Days Strike on 21-22 April 2015 by the Casual & Contract Workers have not been in vain. At least one of the important demands has been settled.
